{"id":8454,"date":"2021-06-11T16:52:30","date_gmt":"2021-06-11T14:52:30","guid":{"rendered":"https:\/\/fge.swebwp.oci.eu\/?page_id=8454"},"modified":"2022-04-21T11:04:48","modified_gmt":"2022-04-21T09:04:48","slug":"auf-welche-leistungen-haben-sie-anspruch","status":"publish","type":"page","link":"https:\/\/fge.swebwp.oci.eu\/de\/startseite\/grenzganger\/deutschland-frankreich\/sozialversicherung\/die-familienbeihilfen\/auf-welche-leistungen-haben-sie-anspruch\/","title":{"rendered":"Auf welche Leistungen haben Sie Anspruch ?"},"content":{"rendered":"\n<p><strong>Wenn Sie in Frankreich erwerbst\u00e4tig sind und allein Ihre Kinder versorgen m\u00fcssen ODER wenn Sie und Ihr Ehegatte in Frankreich arbeiten,<\/strong>&nbsp;haben Sie Anspruch auf franz\u00f6sische Familienleistungen (I).<\/p>\n\n\n\n<p>Wenn Sie in Frankreich berufst\u00e4tig sind und Ihr(e) Ehemann (Ehefrau) nicht besch\u00e4ftigt ist und kein deutsches Ersatzeinkommen erh\u00e4lt, haben Sie einen Anspruch auf franz\u00f6sische Familienbeihilfen, gegebenenfalls wird Deutschland Ihnen eine Differenzzulage zahlen.<\/p>\n\n\n\n<p>Wenn Sie in Frankreich besch\u00e4ftigt sind und Wenn Ihr Ehegatte oder ein Mitglied Ihres Haushalts in Deutschland arbeitet oder dort ein Ersatzeinkommen (Bsp.: Arbeitslosengeld) bezieht, k\u00f6nnen Sie vorrangig deutsche Familienleistungen in Anspruch nehmen (II).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Franz\u00f6sischen Leistungen&nbsp;<\/strong><\/h3>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Folgende franz\u00f6sischen Familienleistungen sind nicht ausf\u00fchrbar:<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\"><li>RSA, revenu de solidarit\u00e9 active (Aktives Solidarit\u00e4tseinkommen),&nbsp;<\/li><li>Besondere Geburts- oder Adoptionsbeihilfen,<\/li><li>Die Familienunterst\u00fctzung,<\/li><li>Beihilfe f\u00fcr Erwachsene mit Behinderung<\/li><li>und das Wohngeld (allocation de logement).<\/li><\/ul>\n\n\n\n<p><strong>Sie k\u00f6nnen diese Leistungen nicht beanspruchen, weil Ihre Familie und Sie nicht im Besch\u00e4ftigungsstaat wohnen.<\/strong><\/p>\n\n\n\n<p>Um die aus Frankreich ausf\u00fchrbaren Familienleistungen in Anspruch nehmen zu k\u00f6nnen,&nbsp;<strong>m\u00fcssen Sie der Familienkasse (Caisse d\u2019Allocations Familiales \/ CA F) folgende Unterlagen \u00fcbermitteln:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>ein Antragsformular f\u00fcr Kindergeld, das Sie bei der Familienkasse anfordern,<\/li><li>das beim Agentur f\u00fcr Arbeit oder bei der CAF zu beziehende Formular E 401 f\u00fcr Angaben zur Zusammensetzung Ihrer Familie,<\/li><li>eine Geburtsurkunde Ihres Kindes oder Ihrer Kinder,<\/li><li>ein Bankverbindungsnachweis (relev\u00e9 d\u2019identit\u00e9 bancaire),<\/li><li>eine Bescheinigung der Agentur f\u00fcr Arbeit \u00fcber die Nicht-Zahlung oder Einstellung von Leistungen.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-pullquote\"><blockquote><p><strong>Sie haben Anspruch auf Beihilfen f\u00fcr die Aufnahme und Betreuung Ihres Kleinkindes: die Kleinkinderzulage (Prestation d\u2019Accueil du Jeune Enfant \/ PAJE)<\/strong><\/p><\/blockquote><\/figure>\n\n\n\n<p>Wenn Sie die Geburt oder Adoption eines Kindes erwarten<strong>, haben Sie Anspruch auf die Leistungen der PAJE (<\/strong>mit Ausnahme der Zulage zur Wahlfreiheit bei der Art der Kinderbetreuung).<\/p>\n\n\n\n<p>Die PAJE-Zulage ersetzt seit dem 1. Januar 2004 alle Kleinkinderleistungen,&nbsp;<strong>die vor diesem Datum erbracht wurden&nbsp;<\/strong>(allocation pour jeune enfant \u2013 Kleinkindbeihilfe, allocation d\u2019adoption \u2013 Adoptionsgeld, aide \u00e0 la famille pour l\u2019emploi d\u2019une assistante maternelle \u2013 Beihilfe zur Besch\u00e4ftigung einer staatlich anerkannten Tagesmutter, allocation de garde d\u2019enfant \u00e0 domicile \u2013 Beihilfe zur h\u00e4uslichen Kinderbetreuung, allocation parentale d\u2019\u00e9ducation \u2013 Erziehungsgeld).<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Falls Ihre Kinder vor dem 1. Januar 2004 geboren sind,&nbsp;<strong>k\u00f6nnen Sie nach wie vor die fr\u00fcheren Leistungen beziehen.<\/strong><\/li><li>Wurde Ihr Kind nach dem 1. Januar 2004 geboren oder adoptiert,&nbsp;<strong>erhalten Sie eine&nbsp;Einmalleistung, die Kleinkinderzulage<\/strong> (Prestation d\u2019Accueil du Jeune Enfant), die folgendes beinhaltet:<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>a) Ein Zuschuss bei der Geburt oder bei der Adoption Ihres Kindes \u2013 nicht exportierbar :<\/strong><\/h4>\n\n\n\n<p>Sie k\u00f6nnen diese Leistungen als in Deutschland wohnende\/r Grenzg\u00e4nger\/-in nicht beanspruchen, weil Ihre Familie nicht im Besch\u00e4ftigungsstaat wohnt.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>b) Eine Grundbeihilfe (allocation de base) \u2013 exportierbar :<\/strong><\/h4>\n\n\n\n<p>Wenn Sie ein Kind von weniger als 3 Jahren versorgen, das nach dem 1. Januar 2004 geboren wurde, oder wenn Sie seit dem 1. Januar 2004 ein Kind adoptiert haben,&nbsp;<strong>k\u00f6nnen Sie eine Beihilfe in Anspruch nehmen.<\/strong><\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Voraussetzungen sind:<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\"><li>dass Ihr Kind sich 3 \u00e4rztlichen Pflichtuntersuchungen unterzieht (die Erste in den ersten acht Tagen, die Zweite im neunten oder zehnten Monat und die Dritte nach vierundzwanzig oder f\u00fcnfundzwanzig Monaten)<\/li><li>und dass Ihr Familieneinkommen unter einer festgelegten H\u00f6chstgrenze liegt.<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-heading\"><strong>Geburt<\/strong><\/h6>\n\n\n\n<p>Folgende nachweise m\u00fcssen in die CAF gesendet werden:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Eine Fotokopie des Familienbuches (Livret de famille) oder eine Kopie des Auszugs der Geburtsurkunde ,<\/li><li>die Gesundheitsbescheinigung des Kindes.<\/li><\/ul>\n\n\n\n<p>Ein Formular kann auf die Website&nbsp; www.caf.fr unter &#8222;Particuliers&#8220; und dann \u201eFormulaires\u201c &nbsp;heruntergeladen werden.<\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><strong>Adoption<\/strong><\/h6>\n\n\n\n<p>Die PAJE wird automatisch bezahlt, wenn Sie die Adoptionspr\u00e4mie erhalten haben.<\/p>\n\n\n\n<p>H\u00f6he der PAJE (seit 2019) :<\/p>\n\n\n<div class=\"wptb-table-container wptb-table-8455\"><div der Berufst\u00e4tigkeit \u00abcompl\u00e9ment de libre choix d\u2019activit\u00e9\u00bb&nbsp;&nbsp; (Clca) exportierbare Leistung :<\/strong><\/h4>\n\n\n\n<p>Diese Zusatzleistung wird nur f\u00fcr die vor dem 01\/01\/2015 geborenen oder adoptierten Kinder bezahlt.<\/p>\n\n\n\n<p>Wenn Sie f\u00fcr mindestens ein Kind unter 3 Jahren zu sorgen haben, das nach dem 1. Januar 2004 geboren oder adoptiert wurde, und Sie&nbsp;oder&nbsp;Ihr Ehegatte Ihre Erwerbst\u00e4tigkeit einstellen oder eine Teilzeitarbeit aus\u00fcben, k\u00f6nnen Sie Anspruch auf diese Ausgleichszulage haben, die einen Teil Ihrer Einkommenseinbusse kompensieren soll.<\/p>\n\n\n\n<p>Allerdings ist diese Zusatzleistung von Ihrer Beitragszeit von 8 Quartalen bei der Rentenversicherung in den 2 bis 5 Jahren vor Ihrer Arbeitsunterbrechung oder Ihrem Umstieg in die Teilzeitarbeit abh\u00e4ngig. F\u00fcr weitere Informationen k\u00f6nnen Sie sich an Ihre Familienkasse (CAF) wenden.<\/p>\n\n\n\n<p>Die H\u00f6he dieser Zusatzleistung h\u00e4ngt von Ihrer Arbeitszeit, von Ihrer Besch\u00e4ftigtenkategorie und vom Bezug oder Nichtbezug der oben unter b) aufgef\u00fchrten Grundbeihilfe ab.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">H\u00f6he der CLCA:<\/h5>\n\n\n\n<ul class=\"wp-block-list\"><li>F\u00fcr die nach dem 01.04.2014 geborenen oder adoptierten Kinder. Juli 2006 und vor 2015 geboren oder adoptiert wurde haben die Wahl sich f\u00fcr das \u00abCompl\u00e9ment optionnel de libre choix d\u2019activit\u00e9\u00bb (Colca) zu entscheiden. Diese Leistung ist k\u00fcrzer als der \u00abCompl\u00e9ment de libre choix d\u2019activit\u00e9\u00bb (12 Monate maximal), hat aber eine h\u00f6here Verg\u00fctung.<\/p>\n\n\n\n<p><strong>Monatlicher Betrag des Clca ist in H\u00f6he von 663,58&nbsp;\u20ac wenn Sie PAJE Beihilfe beziehen.<\/strong><\/p>\n\n\n\n<p>Achtung: Wenn Ihr Kind im 2015 oder 2016 geboren ist, k\u00f6nnen Sie geteilte Erziehungsleistung nachfragen (Prestation partag\u00e9e d\u2019\u00e9ducation de l\u2019enfant).<\/p>\n\n\n\n<p>Die PreParE (f\u00fcr die ab 1. In diesem Fall betr\u00e4gt sie 663,58 \u20ac pro Monat.<\/strong><\/p>\n\n\n\n<p>Die Wahl zwischen den normalen und erh\u00f6henden PreParE ist endg\u00fcltig. Es ist m\u00f6glich, gleichzeitig zweie PreParE&nbsp; innerhalb von ein Paar zu kombinieren, aber die Gesamtmenge beider Leistungen kann nicht \u20ac 405,97 \u00fcberschreiten. M\u00e4rz 2023 geltende Betr\u00e4ge).<\/strong><\/figcaption><\/figure>\n\n\n\n<p>Wenn Ihre Eink\u00fcnfte die Einkommensbemessungsgrenze leicht \u00fcberschreiten, wird Ihnen eine Differenzzulage gezahlt.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Erforderliche Formalit\u00e4ten f\u00fcr den Bezug dieser Zulage:<\/strong><\/h5>\n\n\n\n<p>Sie m\u00fcssen keine Formalit\u00e4ten erledigen, um die Familienzulage zu erhalten. Sie m\u00fcssen lediglich allj\u00e4hrlich Ihr Einkommen bei der Familienkasse angeben, damit Ihnen diese Zulage automatisch ausgezahlt wird.<br>F\u00fcr weitere Informationen wenden Sie sich bitte an Ihre Familienkasse.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>c) Die Beihilfe von Familienunterst\u00fctzung (teilweise exportierbar)<\/strong><\/h4>\n\n\n\n<p>Die Familienunterst\u00fctzung wird unter der Bedingung gezahlt, ein Kind ohne Hilfe eines oder beider Elternteile zu erziehen. Es handelt sich vor allem um die Waisen und die Kinder, deren Eltern getrennt sind und deren Unterhalt von einem Elternteil nicht gezahlt wird.<\/p>\n\n\n\n<p>In einer Entscheidung des Gerichtshofs der Europ\u00e4ischen Union ist geurteilt worden, dass die Vorauszahlungen f\u00fcr Unterhaltskosten exportf\u00e4hige Leistungen sind. (Cir. CNAF vom 2. November 2005).<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Betrag seit dem 1. April 2022:<\/strong><\/h5>\n\n\n\n<ul class=\"wp-block-list\"><li>\u20ac 118,20 \/ Monat \/ Kind, wenn es keine Hilfe von einem Elternteil bekommt<\/li><li>\u20ac 157,57 \/ Monat \/ Kind, wenn es keine Hilfe von einem Elternteil bekommt<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Beihilfen f\u00fcr die Erziehung Ihrer Kinder<\/h3>\n\n\n\n<p>Diese Beihilfen setzen sich aus der Beihilfe zum Schuljahresbeginn und aus dem Erziehungsgeld f\u00fcr behinderte Kinder zusammen.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>a) Die Beihilfe zum Schuljahresbeginn (allocation de rentr\u00e9e scolaire)<\/strong><\/h4>\n\n\n\n<p>Sie haben Anspruch auf eine Beihilfe f\u00fcr jedes Kind zwischen 6 und 18 Jahren, f\u00fcr das Sie unterhaltspflichtig sind, sofern das Kind zur Schule geht, studiert oder in der Ausbildung ist und sein Einkommen 893,25 \u20ac netto im Monat nicht \u00fcberschreitet.<\/p>\n\n\n\n<p>F\u00fcr das Schuljahr 2016-2017 erhalten die Eltern dieser Beihilfe nur f\u00fcr Kinder die zwischen dem 16. September 1998 und einschlie\u00dflich dem 31. Januar 2010 geboren sind.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Ihr Einkommen darf nicht \u00fcber einer bestimmten Grenze liegen:<\/h5>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>Anzahl Kinder im<br>Schulalter<\/strong><strong>(6 bis 18 Jahre)<\/strong><\/td><td><strong>Einkommensbemessungsgrenze<\/strong><\/td><\/tr><tr><td>F\u00fcr 1 Kind<\/td><td>25 370 \u20ac<\/td><\/tr><tr><td>F\u00fcr 2 Kinder<\/td><td>31 225 \u20ac<\/td><\/tr><tr><td>F\u00fcr 3 Kinder<\/td><td>37 080 \u20ac<\/td><\/tr><tr><td>F\u00fcr jedes weiter Kind<\/td><td>42 935 \u20ac<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Die H\u00f6he der Beihilfe zum Schuljahresbeginn ist dieselbe f\u00fcr jedes Kind und h\u00e4ngt von dem Alter des Kindes ab: F\u00fcr den Schuljahresbeginn 2016 \u2013 2017&nbsp;<strong>betr\u00e4gt diese Beihilfe 376,98\u20ac f\u00fcr ein Kind zwischen 6 und 10 Jahren, 397,78 \u20ac f\u00fcr ein Kind zwischen 11 und 14 Jahren und 411,56\u20ac f\u00fcr ein Kind zwischen 15 und 18 Jahren.<\/strong><\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Erforderliche Formalit\u00e4ten f\u00fcr den Bezug dieser Beihilfe:<\/h5>\n\n\n\n<p>Wenn Sie bereits Leistungsempf\u00e4nger(in) sind, m\u00fcssen Sie keine zus\u00e4tzlichen Formalit\u00e4ten erledigen, Sie m\u00fcssen lediglich allj\u00e4hrlich Ihr Einkommen bei der Familienkasse angeben.<br>Wenn Sie nicht Leistungsempf\u00e4nger(in) sind, m\u00fcssen Sie das Formular \u201eD\u00e9claration de situation\u201c (Angaben zum Personenstand) ausf\u00fcllen, das sie bei der Familienkasse anfordern.<br>F\u00fcr weitere Informationen wenden Sie sich bitte an Ihre Familienkasse.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>b) Erziehungsgeld f\u00fcr behinderte Kinder (allocation d\u2019\u00e9ducation de l\u2019enfant handicap\u00e9 \u2013 AEEH) :<\/strong><\/h4>\n\n\n\n<p>Sie k\u00f6nnen diese Leistung in Anspruch nehmen, wenn Sie ein unterhaltbed\u00fcrftiges behindertes Kind unter 20 Jahren versorgen.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\">Die monatliche H\u00f6he des Erziehungsgeldes f\u00fcr behinderte Kinder betr\u00e4gt 130,12 \u20ac ( g\u00fcltig bis zum&nbsp; 31.03.2017):<\/h5>\n\n\n\n<ol class=\"wp-block-list\"><li>f\u00fcr ein Kind unter 20 Jahren, dessen dauernde Behinderung auf mindestens 80 % festgelegt ist,<\/li><li>f\u00fcr ein Kind unter 20 Jahren mit einer dauerhaften Behinderung zwischen 50 % und 79 %, das in einer sonderp\u00e4dagogischen Einrichtung untergebracht ist oder zu Hause von einem speziellen Betreuungs- oder Erziehungsdienst&nbsp; betreut wird.<\/li><\/ol>\n\n\n\n<p>Eine besondere Erh\u00f6hung des Erziehungsgelds kann geleistet werden, wenn das Kinder Empf\u00e4nger der AEEH-Hilfe ist&nbsp;<strong>und<\/strong>&nbsp;von einer Beihilfe der 2., 3., 4., 5. oder 6.
